Houston we have a property line dispute

Hey everyone, we’ve got an interesting story this afternoon about a neighbor who’s probably not the best person to live next to, considering that he threatens to murder you. I just wanted to go over it because I think having good neighbors is so important to a community and I think that it’s hard to quantify what a good neighbor is. So, for example if you never ever talk to your neighbor or if you know don’t have any interaction all with your neighbor that’s okay. That doesn’t hurt the situation but if you do have a neighbor that is threatening to murder you that that’s going to cause some damage to the the fabric of the neighborhood. And you know through all this it’s just one of those things where you know, Could it have been handled better? Could you have started with something as simple as a friendly hello or wave in the morning rather than a threat of murder?

So that’s what we’re going to talk about today.

So the headline is, “Long Island property line feud grows into threatening anti-semitic incident with neighbor.” I’ll just read through it today and then we’ll kind of go over the questions afterwards and so here we go

A couple who left the noise of New York City for the peace and quiet of the Long Island suburbs in 2020 says they have found anything but peace after they claim to have been bombarded with threats from their neighbor over a disputed property line. The people are shaken and scared ten months after the couple left Manhattan for a home in Roslyn Harbor they say they’re being tormented by a neighbor.

“He points to a neighbor he points in the window to me went like this moving his hand across his throat”, Goldman said their next door neighbor looked him in the eye and said, “you’re dead. A doorbell camera captured Tuesday’s expletive filled and anti-semitic rant on video a law enforcement source confirmed to New York that the threatening voice heard in the video belongs to the neighbor. “It’s terrifying honestly the fact that we know this type of behavior is alive and well in 2021 and literally literally living next door”

One of the quotes here it says, “he has issues with a lot of neighbors I don’t know why.” There was no response at the man’s home when the news company knocked on the door they did confirm that the man is banned from village hall due to past disruptive conduct and threatening language and actions.

In a statement the man’s employer said that while it does not discuss personal matters publicly it does hold employees to the highest level of integrity. The statement goes on to say that they will conduct an internal review and they unequivocally condemn any speech or conduct which might be deemed unlawful racist or anti-semitic.

“I just can’t believe that someone could have found that amount of hate towards religion,” Was a quote by the offended neighbor. Then we have another neighbor and it says, “it shouldn’t be tolerated for a nice couple with the child to come in here to be scared.” and finally it says the goldmans were also critical of Nassau police with how they believe the ongoing dispute was handled police said that until there is direct evidence of criminal activity they try to mediate neighbor disputes and so I just wanted to to kind of go over that and see what you thought.

It’s not a good situation by any stretch the imagination but you know I have questions.

So the first question is, What is the property line dispute? Is a survey just not possible? I mean, like 10 weeks ago these people moved in and then all of a sudden all this this starts over a property line. But in the article we don’t know what the property line dispute is and I don’t condone people being you know anti-semitic or any ics, any ics but what’s going on with this this property line?

So that’s that’s that’s my question number one and then number two, one of my thoughts is is the doorbell the doorbell camera catches the incident and so, Why don’t more people have doorbell cameras and are we at a stage now where we all just need to need to get them? It just seems like you’ll read articles where it says crime has gone down across the United States and everything’s wonderful and that we shouldn’t live in a surveillance state and I’m totally fine with that idea but I don’t know that crime has gone down. I don’t know, I mean in 1950 this incident would not have been recorded because there’s no camera on your door. So if you want to split the statistics and say not as much violent crime has happened or whatever-whatever you want to do whatever statistics you want to use that’s fine but that is the case that these type of incidents have probably gone on and just never been recorded. And so I think that it’s worth getting a camera I know that before I started doing this I did look into a security system for the house, or security cameras for the house and now I’m just committed.

Number three is you’re living next door to someone who’s threatened to kill you. Now that that’s not going to be easy as a neighbor and I just wanted I wanted to think about that in the sense that you know it is your property and you can do whatever you want to on your property but isn’t there some sort of moral obligation or ethical obligation to try to treat your neighbors kindly so that everybody can enjoy where they go home at night and where they sleep?

You don’t have to be the best neighbor in the world but you certainly shouldn’t be shouting anti-anti-semitic remarks and threatening to kill your neighbor. That’s not going to be a good situation.

Number four, someone I guess the reporter, reaches out to the employer of the man, and then the question becomes Is it okay to try to get someone fired at work over this situation? There’s a property line dispute. The neighbor threatens to kill the neighbors but does that give license, does that give the neighbors license to find the employer, call the press and get this guy fired so he can never work again? What do you think? If a neighbor is representing the company, you know wearing a shirt, driving a company car and screaming out anti-semitic slurs and just a monster threatening to kill people I can certainly understand. I can understand how an employee would fire somebody in that case but if a guy’s out at his house hanging out on the weekends not on company time is that okay? I don’t know the law on this. I I don’t know.

I mean, obviously it’s a slippery slope, What did the person do? If the person actually murdered somebody, you know, should they be employed? Well they’re not going to be employed because they were hopefully found. Now, threatening, harassing behavior, Is that a cause for, you know, for this type of, I guess I’ll say cancel culture? You have a right to earn a living after you’ve done something terrible? I don’t know but it’s a question and I don’t know that there’s a really perfect answer.

Then finally, actually not finally, next number five is, could this have been handled better? And how? If you leave out the anti-semitism out of the story it still doesn’t make it okay. You shouldn’t threaten to murder your neighbors and that’s kind of the key here. You have a property line dispute that’s clearly gotten out of hand but how could it have been handled better? Are there instances where things are never going to get handled right? Some people are just terrible people, and now you live next door to them. One of the questions I would have is on a disclosure form if you knew you had a neighbor that was unstable and that was the reason why you were leaving, in Saint Louis, like let’s say in Saint Louis or you know in you know Saint Louis Missouri, our state. Do you, as a seller, have an obligation to disclose that your neighbor is an absolute monster and threatened to kill you and that’s the reason why you’re leaving?

It’s really tricky in one sense because you want to be open and honest but at the same time if you put that down there’s a valid concern that no one will ever buy your property. I know what I would counsel my clients to do but I don’t want to put that out on the internet. You know different laws, different states, have different rules and so I’ll just leave that to you. But it is a question that I have and that’s you know, At what point does it become a material issue?

And then finally one bad neighbor. In the article it says everybody kind of knows who this guy is and he seems to have a problem with lots of his neighbors. One fellow seems to make the whole neighborhood go on edge. Good neighbors are so important to everyone’s life. It just shows it only takes one bad neighbor to ruin a good thing, and so you know, keep that in mind. I think during the lockdowns we all saw our neighbors more than we ever did before. but, you know, Is it so hard to, you know, to wave and say hello in the morning or if you see something going crazy, to help out? Offer your assistance? Just the people around you. You don’t have, I mean 30 houses down, that’s a totally different issue but I mean in your very close proximity. You’re going to be with these people for years and you might as well try to make the best of it. That’s just the way I think it should be. I don’t know maybe you’re one of those people that doesn’t like any of your neighbors, and that’s something you’re going to have to deal with.
